3. Nature of the products

The products sold on ShapeVivo are digital content (guides and informational materials in electronic format) relating to wellbeing, nutrition, and lifestyle. They are not physical products: no shipping is involved. The content is provided for informational and educational purposes only and does not in any way replace the advice, diagnosis, or treatment of a physician or a qualified healthcare professional. If you have any medical condition, are pregnant, breastfeeding, or have allergies, we recommend that you consult a healthcare professional before following the purchased content.

4. Prices and payment

All prices are shown in Euro (EUR) and are inclusive of applicable taxes, unless otherwise stated. Payments are processed through the secure payment systems provided by the Shopify platform. We reserve the right to change prices at any time; however, the price applied to an order already confirmed will not change.

5. Delivery and right of withdrawal

As the products are digital content, access to the purchased product is provided immediately after payment is confirmed, via download and/or by email to the address used at checkout. Pursuant to Article 59, letter o) of the Italian Consumer Code (Legislative Decree 206/2005, implementing Directive 2011/83/EU), the 14-day right of withdrawal normally available for online purchases does not apply to the supply of digital content not supplied on a tangible medium once performance has begun with your prior express consent and your acknowledgment that you thereby lose your right of withdrawal. By proceeding with your purchase and obtaining immediate access to the digital content, you provide this express consent.

To the extent permitted by applicable law, Holidaly S.r.l. shall not be liable for any indirect damages arising from the use of, or inability to use, the Services or the purchased content. Nothing in these Terms limits any mandatory rights granted to consumers under applicable Italian and European law.
